In this stage the land court must issue the order for the actual foreclosure and then after this actual stage the foreclosure can actually begin. Unlike other states, Massachusetts is not required to have the lender of a home mortgage notify the borrower that their mortgage is in default before the actual sale. It is for this reason that the rates of foreclosures in Massachusetts are different from other states and are unique. This requires that anyone facing foreclosure in Massachusetts to be extremely proactive with trying to fend off the actual implementation of the foreclosure.
